{"id":2396,"date":"2017-02-16T11:36:00","date_gmt":"2017-02-16T19:36:00","guid":{"rendered":"https:\/\/safecarebc.ca\/?p=2396"},"modified":"2023-10-11T11:47:33","modified_gmt":"2023-10-11T18:47:33","slug":"are-you-ready-for-the-new-johsc-regulations","status":"publish","type":"post","link":"https:\/\/scbcdev.safecarebc.ca\/?p=2396","title":{"rendered":"Are you ready for the new JOHSC regulations?"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\">New regulations for JOHSC effective April 3, 2017<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">SafeCare BC wants to ensure you are prepared for the new Joint Occupational Health and Safety Committee (JOHSC) regulations that will become\u00a0effective on April 3, 2017.\u00a0Under the new regulations employers will now be required to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Evaluate the effectiveness of their JOHSC on an annual basis and<\/li>\n\n\n\n<li>Provide new JOHSC members with at least 8 hours of JOHSC training annually.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">You can <a href=\"https:\/\/bjy6af.p3cdn1.secureserver.net\/wp-content\/uploads\/joint-health-safety-committee-pdf-en.pdf\">review\u00a0the new regulations as explained by WorkSafe BC<\/a>. A high-level overview of these changes is provided below.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">SafeCare will be hosting a teleconference to answer any questions about the changes in regulations on May 8th, 2017 at 1 p.m. Please check our website to register.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Evaluating Joint Committee\u00a0effectiveness<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Section 3.26(2) of the&nbsp;<em>Occupational Health and Safety Regulations (OHSR)<\/em>&nbsp;will now require employers to ensure that an&nbsp;<strong>evaluation<\/strong>&nbsp;of each of its joint committees is conducted annually.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The purpose of the evaluation is to ensure that joint committees are meeting their\u00a0<strong>regulatory requirements<\/strong>\u00a0under the\u00a0<em>Workers Compensation<\/em>\u00a0<em>Act<\/em>\u00a0and the\u00a0<em>OHSR<\/em> and to assess the\u00a0<strong>overall effectiveness<\/strong>\u00a0of the joint committees.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The joint committee evaluations must be conducted by the co-chairs of the joint committee or their designates or the employer or a person retained by the employer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">WorkSafe BC will make an evaluation tool available online that can be used by joint committees to complete their evaluation. Use of the tool is not mandatory \u2013 other tools can be used as long as they meet or exceed all the requirements for an evaluation. One such tool is this&nbsp;<a href=\"https:\/\/bjy6af.p3cdn1.secureserver.net\/wp-content\/uploads\/Committee-Checklist.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">JOHSC Checklist<\/a>&nbsp;from the BCFED\u2019s Health and Safety Centre.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The joint committee must discuss the finished evaluation at the joint committee\u2019s next meeting and may respond to the findings. The joint committee\u2019s discussion and evaluation must be incorporated into the joint committee\u2019s meeting report.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Training for New&nbsp;Joint Committee Members<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Section 3.27 of the\u00a0<em>Occupational Health and Safety Regulation<\/em>\u00a0(OHSR) will now require\u00a0<strong>new<\/strong>\u00a0joint committee members to receive instruction and training\u00a0in the duties and functions of joint\u00a0committees.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This training must be provided to all members joining the JOHSC after the April 3 effective date and <strong>within 6 months<\/strong>\u00a0of the individual joining.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This instruction and training must be a minimum of 8 hours in length and must cover the following six topics:<a href=\"https:\/\/bjy6af.p3cdn1.secureserver.net\/wp-content\/uploads\/JOHS-e1450290297171.jpg\"><\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\" id=\"caption-attachment-3862\">SafeCare BC JOHS Committee Training<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the\u00a0<strong>duties<\/strong>\u00a0and\u00a0<strong>functions\u00a0<\/strong>of a joint committee;<\/li>\n\n\n\n<li>the&nbsp;<strong>rules<\/strong>&nbsp;and&nbsp;<strong>procedures<\/strong>&nbsp;of a joint committee;<\/li>\n\n\n\n<li>the requirements respecting&nbsp;<strong>investigations<\/strong>&nbsp;under the&nbsp;<em>Act<\/em>;<\/li>\n\n\n\n<li>the requirements respecting i<strong>nspections<\/strong>&nbsp;under the OHSR;<\/li>\n\n\n\n<li>the requirements regarding&nbsp;<strong>refusal of unsafe work<\/strong>&nbsp;under the OHSR;<\/li>\n\n\n\n<li>the requirements respecting the<strong>&nbsp;evaluation<\/strong>&nbsp;of joint committees under section 3.26 of OHSR (see above).<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The time to do this training is considered \u2018work\u2019;
